摘要
我国刑事案件中的被害人无法通过刑事附带民事诉讼提起精神损害赔偿,而且被害人损害赔偿权的实现在实践中也缺乏保障。这严重影响了我国和谐社会的构建和法律责任体系的合理化建设,也不符合世界各国立法趋势。因此,我国要借鉴各国立法经验,建立被害人精神损害赔偿制度和被害人国家补偿制度。
In China＇ s criminal cases, the victims can not lodge the spirit eompensation by the civil procedure. However, the realization of the victims＇ compensation right are the lack of security the victims, which has not only seriously affected on building China＇ s harmonious society and constructing the legal responsibility to rationalize, but also ＂unfit in with the trend of legislation in the world. So our country, must learn from the experience of international legislation and build the systems of the spirit damages compensation and the national compensation for victims.
