摘要
我国的《劳动合同法》在一般意义上讲是一部"就业保护法",其颁布实施的确健全和完善了我国的劳动力市场制度。但是,我国的强就业保护立法又可能在失业率水平、长期失业率、青年就业、非正规就业等方面产生一些负面影响。通过对就业保护立法的成本-收益分析得出相关结论:就业保护立法既然是对劳动力市场的灵活性与安全性之间的平衡选择,那么要解决这些负面影响,就要通过加强劳动力市场与其他配套规则的建设来约束其执行,以达到预期的效果。
The "Labor Contract Law'in China improved and perfected the system of labor market in China, which is an employment-protection law. However, the employment-protection law may led some negative impect with the falling unemployment level, long unemployment rates, the employment of the youth and the informal employment, etc. In order to avoid the negative impect the government should strengthen the construction of the labor market and other corresponding rules.
