摘要
实践中事实劳动关系的认定及适用存在着比较混乱的情况,事实劳动关系的保护远远不能适应劳动者合法权益被侵害事实不断增长的趋势,本文主要针对《劳动合同法》实施前我国法律关于事实劳动关系的处理以及《劳动合同法》关于事实劳动关系的有关规定进行分析,并分析事实劳动关系审判实践中存在的问题。
The cognizance and applying of the fact labor relationship in China are somewhat disordered. Labors' rights are not efficiently protected in the fact labor relationship. This article tries to analyze the existing problems in dealing with the fact labor relationship in China before the related Labor Contract Law put into practice.
