我国大型体育赛事运行的法律审视——以全国运动会为例

Legal review of the operation of major sports events in China——With National Games as an example

加强对大型体育赛事运行的法律规范与调控,是依法治体和对赛事提供良好保障的客观需要。以全国运动会为例,从我国现实国情出发,对大型体育赛事运行的法律依据、举办权的依法取得、组委会的法律定位、竞赛主体的法律关系、赛风赛纪的法律规制、市场开发的法律保护、相关风险的法律防范和纠纷争议的法律处理等问题,进行了简要的分析探讨。

Strengthening the legal norms and regulation of the operation of major sports events is an objective need to rule by law and to provide good protection for sports events. Taking National Games as an example from the reality of China＇ s national conditions, we analyze the problems briefly such as the legal basis of the operation of major sports events, obtaining the holding right according to law, winning the bid of hosting sports event according to law, the legal status of the organization committee, the legal relation of main race, the legal regulation of sportsmanship and discipline, the legal protection of market development, the legal prevention of relative risk and dealing with disputes by law, etc.
