摘要
湿地保护对实现我国社会经济的可持续发展具有重要意义,但是我国目前在湿地保护立法方面仍存在着不少问题,完善湿地保护立法已经势在必行。应尽快制定一部全国性的《湿地保护条例》以解决我国湿地保护与管理中的突出矛盾。在该条例中,必须明确以下两点:一是应从我国具体国情出发,在借鉴《湿地公约》规定的基础上,对我国湿地的定义进行适当调整;二是解决管理机构的职责混乱问题,建立与湿地分级、分类相适应的行政管理体制。
Ahbough wetland protection plays an important part in the sustainable development of economy in China, it is imperative for China to make Regulations on the Protection of wetland to solve the problems in the legislation of wetland protection. In the regulation-making process, the definition of the wetland should be adjusted to Wetland Convention as well as national conditions. Moreover, administrative management system in conformity with wetland classification should be set up in order to solve the duty confused problems of management organization.
