基于旅游者权益保护的旅游合同法律问题初探

A Discussion on the Tourist Contract Issue About the Rights and Interests Protection of the Tourists

旅游业中有着复杂的法律关系。随着旅游业的蓬勃发展,各种法律纠纷也日益增多,但多集中表现在旅行社同旅游者之间的合同法律纠纷,涉及从合同的订立、履行、变更到解除等方面,对旅游者的合法权益造成了一定的损害。本文基于旅游者权益保护的视角,重点对旅游合同中全包价旅游合同的概念、内涵和特征,合同法律关系中的主体、客体以及旅游合同纠纷的预防途径和司法救济的法律适用等问题进行了探讨。

Based on the perspective of the rights and interests protection of tourists, the paper mainly discusses the concept, connotation and features of the package tour in the travel contract, the main body and the object in a contract dispute, as well as the ways to prevent the contract dispute and the law application of judicial relief and other issues.
