论中国死刑的立法限制

On Legislative Limit of Chinese Death Penalty

虽然全球多数国家已废除或停止执行死刑,但是,中国至少在社会主义初级阶段不能废除死刑。中国的死刑应该按照相关国际条约的规定,借鉴国际立法例,从适用条件、适用对象、核准程序、执行方式上进一步限制,并尽快建立相应的法律救济制度。

Although most countries of the world have abolished the death penalty, China can not abolish it at the early stage of the socialism. In China the death penalty also should follow the revelant intemational legal rugulations and use international legislation. We should further enhance the restriction in the aspects of suitable eondition, applied object, checking procedure and execution approach. Meanwhile we are supposed to set up eorresponding legal approach. Meanwhile we are supposed to set up eorrespondig legal relief. Meanwhile we are supposed to set up corrsponding legal approach. Meanwhile we are supposed to set up corresponding legal relief system as soon as possible.
