对《物权法》车位规定的思考

摘要 《物权法》74条第二款关于车位的归属采用屋内车位约定的立法规定,但在司法实践上引起了开发商依强势地位制定霸王条款、垄断车位,以及将本应属于业主所有之车位占为己有等情形。针对此种现象,建议对屋内车位归属分为法定共有和开发商所有两种情形,以利于业主合理使用车位。 The second article of clause 74 in Property Law about adoption appointed legislative regulation of parking stall in the room which the parking stall belongs to. But this situation may cause the developer to make overlord' s clause, monopolize parking stall, mistake the parking stall that should belong to owners and take into one' s own possession in accordance with the surging position and so on. To this unjust phenomenon, we call upon to divide into two kinds of situations of legal having the parking stall in the room together and developer and then adjust the structure in detail separately.
