中国的法治发展是与社会结构转型、体制转轨和大国崛起等进程复杂交织在一起的社会总体发展战略的一部分,为化解制度创新、秩序转型与维护国家安全稳定等因素之间的目标冲突,中国法治实际走上了一条政府推进型的渐进发展道路。为此,可以把中国法治发展划分为经济主导的法治建设阶段、社会建设主导的法治建设阶段,以及政治主导的法治发展阶段。当前,中国正处于"社会主导的法治建设"阶段。如果从现在到2020年的中期发展目标能够如期实现,中国预计在2020年有望进入"政治主导的法治建设"阶段。同时也要看到,从现在到2020年之间的不确定因素会导致法治发展的不同前景。

The development of rule of law in China is a part of a general social development strategy and is inter - acted with social structure and regime transformation, and the rise of great power. The development of rule of law in China is actually in the form of government leading and steadily moving forward to solve conflict of different aims. Hence the development of rule of law in China could be divided into three stages as the orientation factors in economy, society and politics, and now we are in the stage of social - orientation. If the mid - term development aim could realize, in the year 2020, China will step into the stage of rule of law with political - orientation. It should be clear that uncertainties between now and 2020 could lead to different prospect of rule of law.
