A Review of Studies on Folk Law in China in 2008

鉴于学术研究的连续性,2008年度中国民间法研究学术报告,继续在民间法的本体研究、民间法与国家法的关系研究、各类民间法研究、民间法司法运用研究等方面,对一年来中国民间法研究所取得的知识增量予以客观呈现。从总体上看,中国民间法研究以一种平稳且积极的姿态向前迈进,无论是走向日常生活的民间法研究,还是深入司法实践的民间法研究,都在原有的基础上努力向纵深发展。而在今后的研究中,我们应当加强民间法总体性研究范式建设、民间法的参与性研究、民间法个案研究的整体考量、民间法司法运用的制度与机制建设。经过多年的努力,民间法话语权逐渐增强,与此同时,我们也许有必要更加清醒地认识民间法研究的意义及其限度。

In view of the continuity of academic research, this paper reviews the latest development in the studies of folk law in China in 2008 in terms of the ontology of folk law, the relation between folk law and state law, the various fields of folk law, the judicial application of folk law. On the whole, the study of folk law in China has been developing smoothly and steadily. Specifically, both the studies of folk law involved in daily life and those of folk law deeply involved in judicial practices have made considerable achievements. In future studies, greater efforts could be made to build the integral research pattern, strengthen participatory research of folk law, improve the overall consideration of case studies, and build the systems and mechanisms for the judicial application of folk law. After years of effort, the folk law has gained a bigger voice. At the same time, we should be aware of the significance and the limits of folk law studies.
