社会转型中农村人民调解的道德环境分析

The Analysis of Moral Environments on Rural People's Conciliation in Transitional Period

曾经被誉为"东方经验"的人民调解制度所经历的地位下降、功能弱化的尴尬局面有着复杂的社会因素。社会转型期农村道德状况的下降使得农村民事纠纷的产生更为频繁与复杂,人民调解所依据的道德规范的统一性受到破坏,大大削弱了情理在调解中的说服作用。人民调解社会功能的有效发挥离不开良好的道德环境:公平正义的社会分配体系,市场经济下的诚信观念,正确的财富伦理,有效的社区舆论机制。

The reasons for the declining and weakening of the people＇ s conciliation system are due to complex social factors. The decline in moral condition in the transitional period makes the civil disputes more frequent and complicated. The unity of the moral standards which the people＇ s conciliation based on is disrupted and the function of reason is greatly undermined. Giving full play to the function of the people＇s conciliation requires good social environments： just social system of distribution, honesty in market economy, correct wealth ethics and effective supervision by public opinions in community.
