摘要
《周易·讼》卦主要涉及诉讼问题,从《讼》卦本身的含义以及历代学者对《讼》卦的解读和称引,我们可以了解中国古代的诉讼观念,这些诉讼观念主要包括贱讼观念、清官情结以及诉讼中的尊卑不犯。这些诉讼观念在当今的中国社会还有一定的影响。从《周易.讼》卦的角度去解读中国古代的诉讼观念,对于深入了解《周易》与中国传统法文化的关系具有积极的价值。
Hexagram Song （ Conflict, hexagram 6 in the received version of the Zhouyi） mainly relates to the issue of lawsuit. From the connotations of hexagram Song and its explanations and quotations by all previous dynasties scholars, we can learn the lawsuit idea in ancient China including the view of despising lawsuit ,the psychological complex of yearning for honest and uptight officials and the concept of that the inferiority should not infringe on the superiority as well. These are of a certain influence upon current Chinese society. Comprehending the idea of lawsuit in ancient China with the hexagram Song of the Zhouyi is of positive significance for us to further understand the relationship between the Zhouyi and traditional Chinese culture of law.
