摘要
医师在实施医疗活动时必须履行知情同意,但是为了最大限度地保障患者的权益,在某些特殊情况下需要免除医师的此项义务。探讨了我国现有的对知情同意免除的规定的不足,论证了解决现存问题的理论依据,并提出了相应的建设性意见。
Doctors must carry out informed consent in medical treatment. However, to ensure patients＇ rights and interests mostly, this obligation needs exempted in some special cases. This article studies the insufficiency in the existing regulation on doctors ＇ obligations exemption. It also lists some constructive suggestions based on the existing theory to solve this problem.
