摘要
《反垄断法》的出台引起社会各界的广泛关注,本文重在讨论渔业与《反垄断法》的关系。《反垄断法》给予农业豁免权,而渔业属于大农业,自然也获得这种豁免权。但是,由于我国现代渔业出现了很多新特点,加上现行渔业法规中存在诸多法律漏洞及渔业垄断现象较为严重。所以,渔业与《反垄断法》的关系不能用豁免权一概而论,而应该具体情况具体分析,尤其是要坚决治理渔业中的行政垄断。
The introduction of the anti-monopoly law has brought great attention to the society. Author has stated the relations of fishery and the anti-monopoly law. The Anti-monopoly law gives the agricultural immunity, agriculture includes fishery. However, there are a number of new features existed in the modem fishery, the relation of fishery and the anti-monopoly law can not be generalized by immunity. We should give analysis on every specific situation. The most important is that administrative monopoly should be removed resolutely.
