FIDIC DBO合同条件索赔及争议处理条款分析

摘要 FIDIC于2008年出版的DBO合同条件的索赔和争议处理条款延续了FIDIC99版"索赔-争议评判委员会-友好解决-仲裁"的体系,但对于业主和承包商间索赔程序的对等性,争议解决条款中各阶段的程序衔接,以及如何进一步预防争议的产生等99版体系在实践运用中出现的问题,均予以了相应的回应和改进。本文对DBO合同条件中索赔和争议处理条款相对于99版体系的回应和改进部分进行分析。
