群众利益诉求的法制化探析

The Legalization Study on the Claim of the People’s Interests

利益冲突与博弈的个体化、群体化产生了群众利益诉求的需求。群众利益诉求要求法制化,但在法制化过程中却面临着实现公平的促进机制不足、诉求机制不足、运行机制不足和保障机制不足等问题。为此,群众利益诉求法制化应立足于三个关系:权利与义务关系、秩序与效率关系、传统方式与现代方式的关系,从利益公平、利益协调、利益表达、利益援助等方面实现群众利益诉求的法制化。

The conflict of interests and the individualized and organized of the game engender the requirement of people＇s interests claim. The claim of people＇s interest needs legalization, but it is faced with some problems which are the deficiencies of boosting-mechanism, claim-mechanism, running-mechanism and guarantee-mechanism of realizing equity in the process of legalization. Therefore, the claim of people＇s interests should be established in three relations： the relation of rights and duties, the relation of order and efficiency, the relation of tradition ways and modern ways, and then achieve the legalization of people＇s interests claim from the aspects of interests-equity, interests-harmony, interests-expression, interests- assistance.
