摘要
特殊侦查行为需要法律的规制。我国现行特殊的侦查取证行为存在适用上的普遍性和法律规制弱化的特点。要保障犯罪嫌疑人的基本人权,改革我国现行侦查机制,必须从我国侦查体制入手,改变无律师参与、无诉讼形态的现状,并相应地引入法律保留原则和比例原则。
The special investigation need legal bound. There are some characters of China＇s current special investigation. That is lack of legal regulation and wider application. In order to protect the basic human rights of the suspects and reform our current mechanism, we should change the status quo of non-lawyers, no litigation morphology and introduce the principle of proportionality and principle of reservation in our criminal procedural systems.
