壮族民间法的遗存与变迁——以广西龙胜县龙脊十三寨之马海村为例

The Remains and Change of the Zhuangs' Customary Law:An Example of Mahai Village,One of the Longji Thirteen Villages in Longsheng County,Guangxi

本文以现实调查资料为基础,通过今昔对比,分析探究壮族民间法的遗存与变迁。作者认为,民间法有效保障了壮族社区的稳定和非诉讼纠纷解决机制的和谐运作。如果能因势利导,更好地改造和利用民间法这一本土性资源以弥补国家调控手段的不足,我们就能够进一步构筑平安新农村的法治秩序,保证社会的和谐与可持续发展。

This paper compares the remains and change of the Zhuangs' customary law basing on the fieldwork.The author argues that the customary law ensure effectively the stabilization of the Zhuangs' community and the harmonious operation of the non-litigious system of dispute resolution.If we give judicious guidance according to the circumstance to re-mould and take advantage of the customary law,the native resource can be a effective complement to the national control.So,we can construct the legal order of safe new village better and ensure the harmonious development of the society.
