A Cultural View on the Concept of Constitutional Politics and Analysis of Cultural Function of Constitutional Politics

民主主义、自由主义、文化主义是当今社会观察宪政问题的三种代表性观点。文化视阈下的宪政指人类社会在现代化进程中,依据宪法在制度性和观念性政治文化动态照应下的一种相对理想的生活方式;与此对应,宪政文化指以宪法为核心,在长期的宪法实践过程中一国公民形成的有关思维方式、价值判断标准、观念和意识等。对政治文明而言,在当代中国,宪政文化有利于德、法、治的统一;有利于权利和权力的统一;有利于实体与程序、过程与结果的统一;从整体上有利于加快从人治到法治的转型。

Democratism, liberalism and culturalism are the three representative perspectives which are used to study constitutional politics. During the process of human＇s modernization, constitutional politics from the perspective of culture is a relatively idealistic living style when constitution is set in contrast with the systematic and conceptional politics and culture. What＇s more, culture of constitutional politics refers to the relevant way of thinking, standard of.value, conception and which are formed by citizens in a country during the long-term practice of constitution. In terms of political civilization, in present China, the culture of constitutional politics is beneficial to the unity of moral, law and governing, the unity of right and power, the unity of entity and procedure, the unity of process and result, and the unity of quick transform from rule of man to rule of law on the whole.
