我国刑法中国有单位受聘人员身份探析

摘要 刑法中国有公司、企业、事业单位受聘人员的身份问题在理论上与实践中都存在很大争议,而身份的界定直接影响到对行为人行为的定性。尽管在形式上刑法中的特定身份可以表现为个人要素,但实质上却体现为行为人对特定行为的特殊认识能力和控制能力。因而,实践中对行为人行为性质的认定与行为人是否具有国家工作人员的身份没有关系,而在于行为人对特定行为是否具有特殊认识与控制能力的资格。 There are very controversial in theory and practice of identity issues of personnel employed by the state-owed company, the state-owed enterprises and institutions in criminal law. The definition of identity has a direct impact for character of the acting of the actor. Although specific identity can be expressed as individual elements in the form in criminal law, but actor for specially acting employing specific cognition capacity and controlling capacity in nature. As a result, there has not relation to ascertain action nature of actor with whether actor has identity of national staff, with actor whether possessing qualifications of specially acting for specific cognition capacity and controlling capacity.
