摘要
以社会性别的视角,从法律方面对文艺复兴时期意大利妇女的地位作了探讨。这个时期意大利妇女的法律地位具有两重性:一方面,她们与男权存在着矛盾,处于依附男性的从属地位;另一方面,她们与男性的利益并不完全对立,也享有一定的权利。不过,当时妇女在法律上受到的保护是在男女不平等的性别文化机制下获得的,并不能改变她们在法律上的弱者地位。意大利文艺复兴运动对人的发现主要是对男人价值的肯定,在这期间,意大利社会的父权制本质并没有改变,传统的性别关系依然牢固,女性的价值和尊严没有得到应有的承认。意大利妇女在文艺复兴时期的处境说明,与生产力和科学技术走向近代的历程相比,人的观念,尤其是性别观念的近代化需要更长时间。
From the angle of social gender, this paper explores the women' s status in Renaissance Italy seen from the perspective of law. The author argues that the legal status of Italian women in that era reflected the characteristics of dualism. On the one hand, women, though in a conflict with androcentrism, were still subject to men. On the other hand, women didn' t oppose all the interests of men and did share certain kinds of limited rights. However, the legal protection of women, which was granted within the system of inequality between sexes, failed to change their weak legal status. The paper points out that the Italian Renaissance' s contribution to ' the Discovery of Man' mainly affirmed the value of men. The essence of patriarchy was not changed yet, and traditional relations between men and women remained stubborn and unchanged. As a result, women still gained no recognition of their value and dignity. The paper maintains that, compared with the developing course of productivity as well as of science and technology towards modern times, the modernization of views on human beings, especially on gender, will take a long time.
