中国传统法律文化当中尽管在表达上没有明文宣示"权利",但是并不乏权利的思想观念,甚至在实践中也不乏保障"权利"的做法,比如对于生命权的尊重、对人身自由权的保护、对财产权的详细规定等。这些都是我们在现代制度建设当中可资利用的本土资源。
