On the Uniformity and Regularity of Legal Language:Using Evidence Law as Language Materials

法律是普遍适用于社会成员的行为准则,因此,法律语言的统一和规范具有较其他学科更为重要的意义。在证据法学领域内,语词使用混乱是语言混乱的主要表象。分析语词使用混乱的原因,可以从法律语言发展过程中的三对矛盾入手,包括精确性与模糊性的矛盾;稳定性与变异性的矛盾;全球化与本土化的矛盾。法律语言学与证据法学之间存在着天然联系,语言分析将开创证据法学研究的新阶段。

Laws are rules of behavior applied generally to the members in a society. Therefore, the uniformity and regularity of language in legal field are more important than in other fields. In the area of evidence law, the confusion of words and phrases is the main phenomenon of the chaos of language. The causes of the confusion may be analyzed through the three contradictions in the development of legal language. They are the contradiction between precision and ambiguousness, the contradiction between stability and variation, and the contradiction between globalization and localization. There is a natural link between forensic linguistics and evidence law. The language analysis will open a new stage for the study of evidence law.
