An Examination on the Concept of Self-governing Intellectual Property Rights

在建立创新型国家的背景下,自主知识产权成为我国现阶段资源配置的重要依据,是政府提供财政资助、金融支持和税收减免的重要依据。然而,现有政府文件和学界的定义不统一,都存在某种程度上过宽或过严的偏颇。根据法解释学和国际私法的基本原理,结合自主知识产权这一概念提出的背景和目的,"自主知识产权"应当界定为:中国人(自然人、法人)最终控制的知识产权,包括专利权及非专利技术、著作权、商标权、植物新品种权等。

Under the background of transfonning China into an innovative nation, the concept of ＇self-governing intellectual property rights＇ is of some practical significance, espeically when it serves as an important factor for resource distribution, such as granting financial subsidy and tax incentives. However, there is no universal definition about ＇ self-governing intellectual property fights＇ in govermental documents or academic publications. Most existing definitions are. considered to be too broad or too narrow. This article reveiws the concept from the perspective of legal interpretation and the general principle of private international law, taking into account the purpose and the background. It argues that the concept should be defined as the intellectual property rights under the ultimate control and disposal of a Chinese （either a legal person or a natural person）, including copyright, trademark, patent, know-how and plant variety rights.
