人民代表大会制度的完善——浅析人大违宪审查制度的架构

中国经济社会处在高速发展和剧烈嬗变时期,由于人民代表大会制度的初创性,还没有真正意义上的违宪审查制度,这与社会主义法治国家的目标有相当之差距。本文试图从一个新的角度对人民代表大会法律监督机制现状、特点和不足以及违宪审查的概念内涵、操作模式二者在我国社会主义国情下的有机结合进行深度的比照研究,回答了人大是否适合建立违宪审查制度?如果适合,如何建立?这两个问题,从而得出在全国人大常委会下设立宪法监督委员会同最高人民法院共同行使违宪审查权的违宪审查机制。

China＇s economic and social development at high speed and intense period of evolution, as the system of people＇s congresses of the initial, is not really meaningful review the constitutionality of the system, which country with a socialist legal system with the aim of considerable gap. This paper attempts to examine a new perspective on the people＇s congress legal oversight mechanisms to the status quo, and the characteristics and inadequate review the constitutionality of the concept of connotation, mode of operation both in the country＇s socialist nation, under the organic combination of depth, mutatis mutandis, answered the suitability of the National People＇s Congress to establish the monitoring system？ If appropriate, how？ These two issues ,thus,it reached the NPC Standing Committee, established constitutionality of the illegal Constitution review mechanism.
