技术标准与知识产权关联及其检验方法研究

研究了技术标准和知识产权之间的异同,技术标准与各类知识产权的关联,尤其是技术标准与专利权的关系。技术标准与专利权的关联包括有权利影响的关联和无权利影响的关联两种,有权利影响的关联是实质性关联。与知识产权产生关联的技术标准制定主要有"知识产权推动型"、"技术标准拉动型"、"技术标准与知识产权互动结合型"三种模式。检验知识产权特别是专利是否结合进技术标准应采用专利侵权判定原则,只有对技术标准产品造成侵权的专利才算与技术标准产生了实质性关联。

This article studies the differences and sameness between intellectual property right （IPR） and technical standards （TS） at fist. IPR which conjuncts with TS includes patents right, trademarks right, copyrights, industrial designs right, new plant varieties right, right of topographies of integrated circuits, right of geographical indications, right of against unfair competition. Then, it focuses on the conjunction between patent right and TS which includes having right influence conjunction and having no right influence conjunction. There are 3 modes for TS establishment ： （ 1 ） IPR pushing mode of establishing TS by integrating existing patent and non - patent technologies. （2） TS drawing mode of establishing TS in advance, then applying patents based on TS. （3） Interacting mode of establishing TS by integrating existing patent and non -patent technologies, then applying patents based on it and revising it. It is necessary to adopt patent right infringement judgment approach to inspect whether TS conjuncts with IPR or not. Only the TS which perhaps infringes the patent right is perhaps conjunct with patent right substantially.
