On the Comparison among Concepts of Crime in the Context of the Modernization of Criminal Law

贯穿刑法现代化的思想主线是形式合理性与实质合理性的融合、社会保护与人权保障的统一。三大法系国家"形式与实质相统一"的犯罪概念结构,体现了刑法现代化的价值理念。犯罪概念的不同立法模式,决定了不同国家犯罪概念内容的差异和犯罪圈大小的不同。犯罪概念的结构体现刑法现代化的价值理念,应当一致;而犯罪概念内容则体现不同国情,可有适当差别。

The mixture of form rationality and substantial rationality and the unity of social protection and guarantee of human fight are the concept of modernization of criminal law. The structure of concept of crime in ＂three genealogy of law＂, unity of form and substance, reflects the value of modernization of criminal law. The difference of content of concept of crime depends on its different legislation modes. The structure of concept of crime in the context of the modernization of criminal law should be consistent, while its content reflecting different country＇s basic condition can be different.
