高等学校的民主监督与权力制约——以教职工代表大会制度为基本形式

我国高校内部民主监督的本质是"以权利制约权力",其基本形式是教职工代表大会制度。新形势下教代会制度作为高校内部民主监督基本形式的地位不会改变,但其面临的问题和挑战导致高校内部民主监督乏力。强化高校内部民主监督效能,必须进一步明确教代会制度的功能,完善教代会制度的内容,创新教代会制度的形式,加强教代会制度的法制化、规范化建设,逐步构建以教代会制度为核心的高校民主监督机制。

The essence of interior democratic supervision in colleges and universities in China is “to restrict power with rights”, whose basic form is teachers′ representative congress system. Under the new situation, the status of teachers′ representative congress system as the basic form of interior democratic supervision in colleges and universities will not be changed, but the problems and challenges it faces will cause weak interior democratic supervision in colleges and universities. To strengthen interior democratic supervision effectiveness of colleges and universities, we must further clarify the functions of the teachers′ representative congress system, perfect the contents, bring forth new ideas to the forms and strengthen the legalized and standardized construction so as to gradually construct the university interior democratic supervision mechanism with the core of teachers′ reprehensive congress system.
