孟德斯鸠的学说和思想集中系统地体现在其代表作《论法的精神》这一鸿篇巨制中。他是西方法学思想史上备受关注的人物,但是有关其立法思想的评述却不多见。事实上,《论法的精神》亦是一部具体深入探讨如何立法的著作,包涵着丰富的立法理论和生动的立法实例。孟氏持积极创制的立法观,寻求影响立法的社会因素和自然因素,提出一系列立法技术要求,以阐明如何创制适合特定社会的特定法律制度。

The doctrine and thoughts of Montesquieu are reflected systematically in his masterpiece The Spirit of the Law. He is the focus in the historical western legal thoughts, but the commentary on his legislative thoughts is less seen. In fact, The Spirit of the Law is also a book discussing in depth how to legislate. It contains rich legislative theories and vivid legislative cases. Montesquieu held on to a positive legislative conception, sought for the social factors and natural factors influencing legislation and contributed a series of legislative techniques, so that he explained in detail how to formulate specific laws in alignment with specific society.
