对制约我国行政监督效能因素的探讨——兼谈改革路径的设计

Discussion on Relevant Factors of Constraints about the Performance of Administrative Supervision

导致我国行政监督不力的原因很多,从外部监督主体看,存在人大、纪委、司法机关、社会力量等独立性不足,权威性不够或力量弱小等原因;从内部监督主体看,监察机关和上级机关或者独立性不足,或者没有监督动力。所以,如何能在当前一元化的权力结构下,提升监督主体的独立性和权威性,就是我们提升行政监督效能的改革思路。同时,对政府的监督必须有强大的外部监督存在,其内部监督才能真正发挥作用,所以行政监督的改革有赖外部政治体制改革的全面推进。

There many reasons to led to administrative supervision poorly. From outside, National People＇s Congress, the Commission for Discipline Inspection, the judiciary, and social forces are all weak; from inside, monitoring bodies and organs at higher levels are dependence or without oversight power. So it is our reform thinking to upgrade the independence of the administrative supervision main. In the meantime, the reform of administrative supervision depends on the reform of political system.
