摘要
研究目的:促进能源事业的发展,为中国设立管道通过权提供理论依据。研究方法:资料分析法和对比分析法。研究结果:管道通过权不同于铁路、公路通过权,也不同于城市地下管网通过权,它实质上可以界定为一种地役权,现有建设用地使用权不能调节油气长输管道建设与经营中的土地权利关系。研究结论:设置管道通过权对管道建设用地的取得、土地利用各方权利的平衡、管道的安全维护及管道廊道生态环境的保护具有重要的现实意义。
The purpose of this paper is to provide a theory basis for the establishment of the passage right of pipelines so as to boost the energy development in China. Methods of documentation and comparison analysis were employed. The results show that the passage right of pipelines is different from the passage rights of the railways, highways and urban underground pipe networks. In fact, the passage right of pipelines can be defined as a kind of easement, and the current land use right for construction can not be used to adjust the relationship between the construction of long-distance oil & gas pipelines and the land right in operation. It is concluded that the establishment of pipeline passage right has important realistic significance for the acquirement of pipeline construction land, the balance between relevant land users, safety and maintenance of the pipelines as well as the ecological environment protection along the pipelines.
