摘要
改造罪犯思想是具有中国特色的一项罪犯改造制度,而且曾经取得了巨大的成功。在新的形势下,特别是在行为矫正理论的冲击下,思想改造制度出现了诸多困境,如其正当性与必要性的冲突,改造方式脱离实际,改造目标与效果的差距,等等。思想改造制度应有所限定地使用,同时应完善相应的改造手段。
Remoulding the criminal mindset is a reform system for criminals with Chinese characteristics, which has become a great success. However, under the new situation, particularly under the impact of Behavior Correction Theory, the system for remoulding the criminal mindset is faced with many difficulties, such as the conflicts between its validity and necessity, the separation of the means of remoulding from the reality, and the gap between the goal and effect of the remoulding. In this paper it is argued that the system for remoulding the criminal mindset should be in limited use and that the means of remoulding should be improved.
