Discussion on the Implied Reverse Counterfeit Behavior of Trademarks and Its Legal Regulations

文章分析了我国商标隐性反向假冒行为司法实践状况,探讨了我国现行法律对商标隐性反向假冒行为的规制存在的问题。根据商标反向假冒行为有关理论,结合我国法律规制存在的问题,提出了进一步完善我国商标反向假冒行为法律规制措施。

The judicial practice of trademark＇ s implied reverse counterfeit behavior is analyzed and the problems existing in Chinas laws on regulations of the implied reverse counterfeiting are discussed. Finally, according to the theory of implied reverse counterfeit behavior and the existing problems in the legal regulation, some measurements to improve China＇ s legal acts of implied reverse counterfeiting regulation are proposed.
