摘要
刑罚的公正关系着刑法目的的实现,针对司法实践中不公正的现象,引发了学术界对刑罚目的、对犯罪嫌疑人、被告人权利保障和刑罚制度重建的探讨反思,本文围绕公正的实质内涵追溯,力求对我国刑罚制度的重整提出建设性意见,以促进我国刑法功能的实现。
The justice of penalty is related to the realization of the purpose of criminal law. The phenomenon of the injustice in judicial practice leads to academic circles＇ discussion about penal purpose, suspects, the guarantee of rights of accused and penal system rebuilding. According to the material content of justice, constructive suggestions about our to promote the realiztion of our country＇ s criminal function.
