论法律的多中心性与趋同化

On the Polycentricity and Assimilation of Law

20世纪90年代掀起的"法律多中心性(legal polycentricity)"的新法理学运动主张法的非普遍性和同一法律制度下价值的非普遍性的观点,拒绝接受道德和法律问题的单一价值方法。但是法律的趋同化特点与法律的多中心性特点统一贯穿于现代法律的发展变化过程中,在法律渊源、法律部门(法系)、法价值、法的道德性和西方法学思想流派五方面,法律的多中心性和趋同化特点共存。这也是完全符合马克思辩证唯物主义关于事物的矛盾统一原理的。

The new jurisprudential movement of ＂legal polycentricity＂ inaugurated in 1990s accepts the non-universality of law and the non-universality of values within a legal system, and rejects the single-value approach to matters of morals and law. But the characteristics of assimilation and polycentricity of law run through the process of modern legal development and changes, and there coexist the characteristics of polycentricity and assimilation of law in five aspects of legal sources, law branches （legal families）, values of law, morality of law and western schools of legal thought, which totally conforms to the Marxist＇s dialectical materialist principle concerning the contradictoriness and unification of things.
