我国现有的刑事程序法律、法规及司法解释关于未成年人刑事案件的规定多与审判程序相关,涉及侦查程序极少。由于侦查程序是诉讼的基础程序,关系到未成年人刑事案件的正确处理,有必要针对未成年人这一特殊群体,设立特别的侦查机构和侦查人员、建立合适成年人参加侦讯、律师法律援助前移、强制措施谨慎使用等系列权利保护性制度及法律监督措施,构建未成年特别侦查程序制度,以实现社会安全和未成年人权益的双重保护目的。
