摘要 自《劳动合同法》颁布以来,无固定期限劳动合同即引发了社会各界的激烈争论,企业更是如临大敌,千方百计规避与员工签订无固定期限劳动合同。从无固定期限劳动合同的立法背景和目的入手,分析无固定期限劳动合同的含义和适用情形,阐明对无固定期限合同变更和解除条件的误读,并探讨实践中出现的问题及其解决途径。 Since the enforcement of Labor Contract Law, the non-fixed term labor contract sparked fierce debate over the community. Enterprises are on their guard and do everything possible to avoid sign non-fixed term labor contract with their employees. The legislative background and the purpose of non-fixed term labor contract are introduced. The meaning of the non-fixed term labor contract and applicable cases of it are analyzed. The misreading for conditions of contract change and lifting of non-fixed term labor contract are explained. Solutions for the practice problems are put forward.
