摘要
现代民法中的占有制度是罗马法和日耳曼法两种占有制度的融合。确立我国民法的占有制度有必要对其进行逐一探讨。罗马法与日耳曼法在占有的性质、效力、保护以及该制度的功能上都存在许多差异。
The prosperity law in modern civil laws is a combination of Roman prosperity system and Germanic prosperity system. It is quite necessary to explore them one by one to ensure the prosperity system in our country. There exist a lot of differences between Roman and Germanic Laws in nature, validity, protection and function of prosperity system.
