基于人类居住权的“城中村”改造模式与路径探索

The Path to the Reconstruction of "Villages in Cities" on the Basis of Housing Rights

本文以保障"城中村"主要社会群体——低收入外来人口的居住权为研究出发点,在分析已有"城中村"改造模式的缺陷后,提出政府不直接联合市场,而是"政府+社区",然后"社区寻求市场"的改造模式,并进行路径设计.该模式的特点是不需要政府提供不可负担的改造资金,但又能最大限度地保证社会公平,是一种能够自我运行的可持续模式.

Based on the guarantee of housing rights of low-income settlers from other places, this article first analyses the drawback of the present model for the reconstruction of ＂villages in cities＂ and then puts forward the model that the government doesn＇t seek market directly. Instead the govemment cooperates with communities, and communities seek market. This model, which not only doesn＇t require the government to provide a great amount of money for reconstruction but also can greatly ensure social equality, is a sustainable way of reconstruction.
