建立我国被害人国家补偿制度的构想

The Conception on Building the National Compensation System to Victims in China

被害人问题是伴随着犯罪问题而存在的一个重要社会问题,但长期以来被害人权利问题却未受到社会足够关注。二战后,世界上大部分国家纷纷建立了被害人国家补偿制度,但却是我国刑事立法上长期存在的一项空白。本文在立足于我国司法现状的基础上探索了构建我国被害人国家补偿制度的道路。

Along with the matter on crime,the matter on victims' rights is very important and social prob-lem.But people haven't paid enough attention to it for a long time.With development of the human rights movement,the protection to victims is paid more and more attention gradually after World War Ⅱ.Most of countries in the world begin to build national compensation systems one after another,while it has been a gap in criminal legislation in our country for a long time.Based on the current administration of justice in our country,the article attempts to build the national compensation system to victims in our country in order to serve better for our socialistic construction on legal system.
