立功价值的求证:国家功利抑或公平正义

Confirmation on the Value of Meritorious Service: National Utilitarian or Fairness and Justice——Reflection from "Prisoner's Dilemma"

作为激励机制,立功制度在打击犯罪,维护社会安宁中发挥着重大的作用,但是,立基于功利主义的立功制度在一定程度上以牺牲公正正义为代价的。由于立功去动机化的成立要件,在现实语境下,出现了大量的立功"异化"的现象。针对"囚徒困境"催生的立功"异化",司法机关陷入两难的境地。为了解决司法实践中立功"异化"现象,应淡化立功的国家功利色彩,适时地调整立功制度。

As an incentive mechanism, meritorious service system is playing a major role in combating crime, mainmining social stability. However, based on utilitarianism, meritorious service system is at the expense of fair justice to a certain extent. As to unmotivated elements in the context of meritorious service, a lot of ＂alienation＂ meritorious service is coming up being. Facing up to ＂alienation＂ meritorious service hastened by ＂Prisoner＇ s Dilemma＂, the judiciary is deep into a dilemma. In order to solve ＂alienation＂ meritorious service in the judicial practice, we should fade utilitarian color of meritorious service system, and timely adjust meritorious service system.
