浅析债权人代位权

Brief Analysis of Creditors Right of Subrogation

文章从代位权的概念、意义入手，对行使的主体及构成要件、行使方式、范围、效力进行了分析，结合法律工作实践，对代位权诉讼中的问题进行了总结归纳，对于有争议的问题提出了相应的见解，对债权人实现债权具有重要的启示作用。

Starting with the concept and meaning of subrogation right, this paper analyzes performing subjects, constructive conditions, scope and effectiveness; summarizes the issues of subrogation litigation; and presents the idea on controversial issues, which have important implication for realization of creditor claim.
