Research on Movable Property Transaction and Guarantee System in the Song Dynasty

宋代的担保行业是其商品经济高度发展的产物,担保行业适合了其商品经济高度发展的需要,并贯彻到了商品交易的各个方面,发挥着重要作用。尤其在预买和赊买卖中,担保的作用更为凸现。宋朝法律赋予保人以特殊的经济地位和权利,是宋代担保制度发达的重要原因。从整体来看,宋代担保行业与其商品经济高度发展之间既有相适合的一面外,也有不相适合的一面,而且不相适合的一面又严重阻碍了宋代商品经济的发展。

The guarantee business in the Song Dynasty is the result of the highly-developed commodity economy. Guarantee business accords to the need of the development of commodity economy, exists in very aspect of commodity transaction, and plays an very important role. An important reason of the highly-developed guar-antee system in the Song Dynasty is that the Song DynaSty law grants guarantors special economic status and power. As a whole, there compatible and incompatibie aspects between guarantee system and highly-developed commodity economy, and the incompatible aspects hinder the commodity economy from developing in the Song Dynasty.
