论社会中间层及其在经济法中的角色定位

社会中间层主体是对"政府—市场"二元主体框架的突破,是经济法主体的新发展。社会中间层的兴起有其深刻的经济社会根源,是市场经济发展到一定阶段,政治国家与市民社会互动互融的产物,是政治资源、社会资源和文化资源由政府向民间分流的结果,同时也是对民间资源向政府不断挤入的确认。社会中间层主体不仅发挥着分离于政府职能和升华于市场权能的功能,而且还具有沟通协调、保护恢复等独有作用,并呈现特别保护性、辅助政府调控性、公共服务性和自治性等多种团体类型。各国应采取有效措施引导和规范社会中间层的健康发展,以克服其局限性。

The social intermediary organs are a breakthrough of ＂government-market＂ two-tier structure and a development of the economic law parties. The appearance of social intermediary organs have profound economic and social origin, when the market economy evolves at a certain phase, it is the result of political state and civil society mutual coordinate and merge, the consequence of political resources, social resources and cultural resources detouring form government to civil, and the affirmation of civil resources entering the government. The social intermediary organs not only exert the function of departing form government but also subliming form market, besides the unique function of communicate and coordinate, preserve and reinstate etc, and emerge multiple organization classes of special conservancy, assisting government regulation, public service, autonomy etc. Every country should take effective measures to guide and plan the legitimate development of the social intermediary organs, restricting its limitation.
