对未成年人之监护人的民事责任的研究

Research into the Civil Liability of Juveniles' Guardian

由于未成年人的权利能力的实现因民事行为能力之不足而受影响,对于监护人的职责和承担的民事责任的研究就尤其显得重要。从监护人对被监护人的民事责任及其构成,未成年人侵权监护人的民事责任,在校期间未成年人被侵权学校承担的民事责任等诸方面对监护人的民事责任进行研究,并针对监护人的民事责任制度,尤其对校期间未成年人、没有完全民事行为能力的人和限制民事行为能力人的保护进行分析,希冀对监护制度的完善和发展有所裨益。

Due to minor＇s droit ability＇s realization are affected by their short of civil behavior ability, lack of the right understanding on their self-behavior＇s social aftereffect and legal content, which lead to the delict or make damage to others＇ legal rights and interests, will affect the society＇s order in gear, so the study for guardian＇s responsibility and assumed civil responsibility seerns more important.. In the following paper, I listed the structure of guardian to minor＇s civil responsibility, the rule which need to be followed, minor＇s intruded guardian＇s civil responsibility, the invaded school＇s civil responsibility, and talking on guardian＇s civil responsibility. Aiming at guardian＇s civil responsibility system, especially for those minors who are still at school, or for those who are lack of entirety civil behavior or who are restricted civil behavior ability Ward ship＇s institution＇s consummation and development need the full society＇s effort.
