摘要
P2P技术下载广泛存在,各国司法实践中对其是否属于合理使用态度不一。以美国版权法中确立的"四个检验标准"为依据,对P2P技术网络下载行为是否属于合理使用进行了分析,最后得出该行为不属于合理使用的结论。
P2P downloading technology,which gives rise to different attitudes towards whether it is fair use or not, exists widely around the world. This paper provides that it doesn＇t belong to fair use by analyzing the rationalization of P2P network downloading behavior on the basis of the ＂Four Standards＂ in America Copyright Law.
