地役权的现代化

The Modernization of Servitude

地役权为一种重要之用益物权,因应地役权之现代化,我国台湾地区本次"民法"物权编修正,研议就地役权之适用范围予以扩大,将传统仅适用于土地及土地所有权人之地役权扩及至其他不动产和不动产用益权人,将"地役权"概念修正为"不动产役权"。

As a kind of usufruct, servitude is very important. In order to meet the modern requirement, the modification of the charter of property law of Taiwan ＂civil law＂ has expanded the applicable scope of servitude. According to the modification, the estates and right owners of estate other than land and ownership of land may be involved in the institution of servitude. Accordingly, the conception of ＂servitude of land＂ should be amended as ＂servitude of estate＂.
