Study of the Criminal Characteristic in Criminal Jurisprudence——From the Angle of Legislation and Judiciary

目前我国刑法学中有关犯罪特征的争论,其核心就是没有明确在何种意义上讨论犯罪特征问题。从刑法学研究类型的角度分析,刑法学中有关犯罪特征的研究包括面向立法的研究和面向司法的研究,面向立法的刑法学研究认为犯罪的特征是应受刑法惩罚的社会危害性,面向司法的刑法学研究认为犯罪的特征是刑事违法性。

We haven＇t made it clear that we should discuss criminal characteristic in what way. It is the debatable core about criminal characteristic in our criminal jurisprudence. There is the legislative and judicial study about criminal characteristic in criminal jurisprudence from the angle of investigative type. The criminal characteristic is harm to society which should be punished from the angle of legislation. The criminal characteristic is criminal illegality from the angle of judiciary.
