摘要
教育法律观念是人们对于教育法的基本倾向及对教育法律现象的态度、认识与评价。教育法治既是一种制度,也是一种精神,是制度和精神的有机体。近年来我国教育立法的力度较大,教育法律体系的框架已基本形成。但同时也应看到,不少人的法治观念尚未及时转换,一些传统的落后观念阻碍和制约着制度性法律文化作用的充分发挥,教育法治的精神底蕴尚显不足。要使传统的法律观念实现转换,并与现代教育法律精神相协调,首先应根植于本土文化,立足当代教育法治的需要,吸收我国传统的人文精神,并对其加以筛选、提炼,进行创造性的转化;同时结合我国实际,借鉴、吸纳西方人文精神中的一些先进观念。重塑现代教育法律观,启蒙教育也至为关键。
Educational legal idea is the basic propensity that people think of educational laws, and the atritude, cognition and assessment of its phenomena. Education under the rule of law is not only a kind of system, but also a kind of spirit; it's the organism of the two. Owe to the development of educational laws in recent years, the frame of educational legal system has formed. At the same time, we should also see the problems made by the behindhand traditional legal ideas and so on. How to make the transition and coordinate traditional legal idea with modern spirit? Begin with our homeland culture, we should meet the present needs, and refine the humanity spirit of our country and transform it creatively. On the other hand, referring to the advanced ideas in western culture which fit for our reality is recommended. Enlightenment education is also crucial to rebuild modern educational legal idea.
