Global Justice and International Institutional Design:The Case of International Criminal Court

全球正义是否可能以及如何可能的问题一直是世界主义与社群主义这两大国际关系规范理论争论的焦点问题之一。作者绕开理论层面抽象的争论,在明晰全球正义概念的基础之上,着力从实现路径的角度论证了全球正义的可能性,并指出:二战后尤其是冷战结束以来,以全球正义为规范基础的国际制度设计在国际社会得到很大程度的发展,成为国际制度发展的一个新趋势,国际刑事法院就是其中一个典型的案例。

Whether and how to realize global justice has long been one of the key issues in the debate of Cosmopolitanism and Communitarianism.The article first defines the concept of global justice,and then suggests view the competition of these two norms through the lens of international institutional design.In the post world war II era,especially after the cold war,more and more institutions are designed based on Cosmopolitanism,which suggests a new trend of the development of international institutions:International Criminal Court(ICC)is a good example.
